CUANTIK Terms of Use and License

Last updated: [PUBLICATION DATE]
Provider: CIECSA PROYECTOS, S.A. de C.V. ("the Provider"), Mexican tax ID (RFC) CPR250509285, Monterrey, Nuevo León, Mexico. Contact: [email protected].

1. Acceptance

By creating an account or purchasing a plan, you accept these terms. You can read and download them before paying.

2. Service

CUANTIK is online software for unit price analysis and construction cost estimates, offered by subscription.

3. Plans and prices

PlanPrice
33-day trialUS$17.99
MonthlyUS$35.99
AnnualUS$349

Prices are shown in the currency for your country before you pay (Mexico: MXN, 16% VAT included). The total price and billing period are shown before any charge. Price changes are announced at least 30 days in advance and apply from the next renewal; if you disagree, you can cancel without penalty.

4. License

The Provider grants a non-exclusive, non-transferable license, revocable under these terms, personal and valid for one user per account, while the subscription is active. You do not acquire ownership of the software.

5. Prohibited uses

You may not: a) copy, reproduce or modify the software; b) resell, sublicense, rent or commercially exploit access; c) reverse engineer, decompile or disassemble it, except where the law expressly allows; d) use bots, scraping or other automated means to extract data or catalogs; e) share your credentials or let others use your account; f) try to bypass security measures; g) use the service for unlawful purposes.

6. Your content

The projects, estimates and data you enter belong to you. The Provider uses them only to deliver the service. You can export them while your account is active and for 30 days after cancelling.

7. Suspension

If you breach section 5 or miss a payment, the Provider may suspend the account after notifying you by email and giving you reasonable time to fix it. Serious breaches (for example copying or attacking the system) may lead to immediate suspension with notice afterwards. If a suspension turns out to be unjustified, the Provider refunds the unused period.

8. Responsibility for calculations

CUANTIK is a support tool. You must review the results—especially materials, productivity rates, prices and factors—before using them in bids or contracts. The Provider is responsible for defects attributable to the software and will make reasonable efforts to fix them promptly, but not for decisions made without that review or for incorrect data you enter. Except for fraud or gross negligence, the Provider's liability is limited to the amount you paid in the previous 12 months. Nothing here limits your rights under Mexico's Federal Consumer Protection Law (LFPC).

9. Availability

The Provider aims for reasonable availability and gives advance notice of scheduled maintenance. If an outage attributable to the Provider lasts more than 24 continuous hours, you may request proportional service days as compensation.

10. Intellectual property

Trademarks, code and design belong to the Provider.

11. Billing and payments

Payments are processed by PayPal (payments from outside Mexico) or Mercado Pago (payments from Mexico); CUANTIK never stores full card details. Mexican tax invoices (CFDI) are available only for customers in Mexico.

11 bis. Payment methods and optional automatic recurring charges

You choose how to pay and can change it at any time under "My account":

a) Manual payment per period. You pay each month or year when you decide. Nothing is charged unless you pay. If you don't, access ends when the paid period expires, with no penalty or debt.

b) Automatic recurring charge (optional) to your card or payment account:

  1. Express consent. It is only activated if you choose it through an affirmative action (unchecked box and an "I authorize automatic charges" button). The authorization states plan, amount, billing period, payment method (last 4 digits) and date of the first charge. You receive an email receipt and the Provider keeps a timestamped record. Charges are made through PayPal (payments from outside Mexico) or Mercado Pago (payments from Mexico) under their own terms; you can cancel them from "My account" or from your PayPal / Mercado Pago account, and you keep your right to dispute charges with your card issuer.
  2. Notice before each charge: at least 5 calendar days before on monthly plans and 15 calendar days before on annual plans, with amount and date, and the option to cancel without penalty.
  3. Cancellation without penalty, in the same number of steps it took to activate, effective immediately for future charges, with email confirmation. Cancelling automatic charges does not cancel access you already paid for.
  4. Right to dispute charges with your bank or card issuer at any time within the applicable deadlines. Any incorrect charge is refunded in full.
  5. Payment details are received and stored only by the payment processor (e.g. PCI DSS). CUANTIK stores only a token and the last 4 digits.
  6. 33-day trial does not turn into an automatic charge unless you expressly activate automatic charges.
  7. Declined charge: you are notified and can pay manually; no interest or penalties apply.

12. Cancellation and refunds

See the Cancellation and Refund Policy below, which forms part of these terms.

13. Changes to the terms

Changes are announced by email at least 15 days in advance. If you disagree, you can cancel without penalty.

14. E-commerce and record keeping

Transactions are governed by the LFPC (chapter VIII bis), the Mexican Commercial Code (art. 89 et seq.) and NOM-151-SCFI-2016 where applicable. The Provider keeps evidence of your acceptance of these terms.

15. Governing law and jurisdiction

These terms are governed by the federal laws of Mexico. Disputes are submitted to the competent courts of Monterrey, Nuevo León. Consumers keep their right to go to PROFECO and to the courts of their place of residence, and any mandatory consumer rights of their country.

16. Contact and complaints

Email: [email protected]. Response time: 5 business days.
